1) Who we are

Automate The Journey (“ATJ”, “we”, “us”) provides done-for-you marketing automation and AI teammates for independent service businesses.

2) Using our services

  • Eligibility: You are a business, not a consumer, and you have authority to bind your company.
  • Acceptable use: No spam, unlawful content, harassment, or deceptive practices. Honor SMS/email opt-in/opt-out rules (e.g., STOP/HELP).
  • Your content: You’re responsible for accuracy and legality of data you provide (contacts, messages, assets).
  • Third-party tools: We integrate with vendors (e.g., email/SMS gateways, calendars). Their terms apply too.

3) Fees & billing

  • Flat-rate plans: Subscription fees are monthly unless specified otherwise.
  • Usage: Plans include posted caps. Overage rates are transparent and may be optionally capped.
  • Invoices & payment: Due upon receipt. Late amounts may incur reasonable admin/interest charges.

4) Term & cancellation

  • Month-to-month: Cancel anytime; service continues until the end of the billing period.
  • Data exports: On request, we’ll export your data (subject to law and platform limits).
  • Suspension: We may suspend for non-payment or policy violations, with notice where reasonable.

5) Confidentiality & IP

  • Confidentiality: We keep your non-public information confidential and use it only to serve you.
  • Your IP: You retain rights to your brand, content, and data.
  • Our IP: We retain rights to templates, playbooks, and software we provide. We grant you a license to use deliverables in your business.

6) Warranties & disclaimers

  • As-is: We provide services using reasonable care. We don’t guarantee a particular revenue outcome.
  • Availability: We aim for high availability but occasional maintenance/outages may occur.

7) Liability

  • Limits: To the maximum extent permitted by law, our aggregate liability is limited to the amounts you paid in the 3 months before the claim.
  • No indirect damages: We’re not liable for lost profits, revenue, or incidental/consequential damages.

8) Compliance & data protection

  • You act as data controller for your clients. We act as your processor. See our Trust Center and DPA for details.

9) Changes

We may update these terms. If changes are material, we’ll notify account owners or post a banner in-app or on the site.
